These Terms of Service ("Terms") govern your access to and use of Barry Counter (the "Service"), a mobile application available on iOS and Android operated by Barry Counter ("we", "us", or "our"). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service. By using Barry Counter, you confirm that you meet this requirement. The Service is not intended for children under 13, and we do not knowingly allow them to create accounts.
Barry Counter is a personal tracking app that lets you count and log everyday habits, view your statistics and history, set optional location-based reminders, and—if you choose to sign in—compare scores with friends and on leaderboards. Features are provided on an "as is" and "as available" basis and may change, be added, or be removed over time.
You can use the core counting features without signing in. Social features (friends, leaderboards, and synced data) require you to sign in:
Authentication is handled through these platform game services and Firebase Authentication. You are responsible for activity that occurs under your account and for keeping access to your device and game-service account secure. We are not responsible for loss arising from unauthorized use of your account.
When using the Service, you agree that you will not:
Barry Counter lets you attach a daily photo to your count and choose whether to keep it on your device only, share it with friends, or show it on the global leaderboard. You retain ownership of the content you create. By sharing content with friends or on the global leaderboard, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content solely for the purpose of operating and providing the Service.
You are solely responsible for the content you upload, and you agree not to upload images that:
Shared images are screened automatically and may be reviewed, reported, removed, and acted upon as described in our Privacy Policy (Section 9). We may remove content and suspend or terminate accounts that violate these rules.
The Service, including its software, design, text, graphics, logos, and other materials (excluding your user-generated content), is owned by us or our licensors and is protected by intellectual-property laws. We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own personal, non-commercial use, subject to these Terms.
The Service relies on third-party platforms and services, including Apple Game Center, Google Play Games, Google Firebase, and Google Maps. Your use of those services is also subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.
The Service is distributed through the Apple App Store and the Google Play Store. Your download and use of the app is also subject to the terms and policies of the applicable app store. The app stores are not parties to these Terms and are not responsible for the Service.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure. Barry Counter is a self-tracking tool and is not a medical, health, or professional advice service; you should not rely on it as such.
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including under mandatory consumer-protection rules.
You may stop using the Service at any time and may delete your account and data at barry-counter.com/delete-account. We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice within the app. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules. If you are a consumer, you may also benefit from any mandatory protections of the law of the country in which you reside.
